Terms of Use

By using the services offered on thesurpriser.com the user agrees to the terms mentioned herewith :

• The user should carefully read the description of gifts, shipping declaration and destination information before placing the order.


• All prices are in Indian rupees and the gifts are delivered only in India.


• During occasions, the orders are processed by the FIFO principle. Thus, if your order is received late (closer to the occasion date), your order might be delivered on the next working day or later. We do not take any responsibility for such late deliveries.


• We reserve the right to change the price of any gift, without prior notice.


• In case of exchange / return of Gifts, all the cost of courier and other charges would be borne by the recipient of the Gift.


• We are taking orders for Valentine's Day only till 12 Noon (India Time) on 13th February. Orders placed thereafter may not be delivered on 14th. If not delivered on 14th, the same shall be delivered on 15th or 16th February.


• On occasions, owing to the number of orders, the order might be delivered before or after the selected date.


• All deliveries are done during the day time between 8 AM to 8 PM. If you have mentioned a specific time of delivery above, we will try our level best to follow the same. Products which are couriered can only be delivered at a residence or a business address, they can not be delivered to a wedding hall or a function hall. Products which are delivered by hand, can be delivered to any address given by you.


• The date of delivery selected by you will only applicable for perishable gifts like flowers, cakes, fruits etc.


• Non-Perishable products (like Gift vouchers, perfumes, watches etc) are sent by courier and cannot be delivered on a specific day. We will email you a tracking no. once the items are couriered


• We reserve the right to cancel any order without providing any reason. This will be regardless of whether the payment has been confirmed / received. Payment for the cancelled orders will be refunded and the user will be informed. Refund can sometimes take upto 31 days to take effect.


• For orders in which problem arises owing to the mistake of the user e.g. wrong address or incomplete information or recipient not reachable, no refund will be given. Redelivery charges, if any, will be borne by the user.


• The user agrees to give the correct information which is true and authentic. We reserve the right to confirm the information provided by the user. We also reserve the right to disallow any user to use this website and may reject / cancel the registration without providing any reason whatsoever.


• The user confirms that he / she is at least 18 (eighteen) years of age or has a consent of a parent or a legal guardian.


• In an event the ordered flowers / sweets / chocolates/ cakes are not available in the selected city / town; they will be replaced with available flowers / sweets / chocolates of equal or higher value.


• We deliver only eggless Cakes.


• No claim of whatsoever nature under any circumstances will be tenable other than the claim for 100% refund of payment made. All such claims if any, are to be raised within 24 hours of delivery /non delivery. Refund can sometimes take upto 31 days to take effect.


• We are not responsible for any kind of mishandling of credit card information given to Paypal, the authorized online retailer, for the orders placed. Please take care that your card is not used in an unauthorized manner. We shall not be responsible for your card being charged in this manner. However if your card has been used without authorization, you should advise us the moment you receive the E-mail confirmation of the order which was placed.


• We shall try its best for prompt delivery; However delayed/early delivery for whatever reason shall not entitle the user for any damages or compensation.


• Inspite of full caution taken at the time of delivery, we will not be responsible for a mis-delivery if the receiver of the gift at the address on the order form misappropriates, damages or fails to hand over the gift to the person named on the order form and takes the item posing himself to be the correct person.


• The product/services provided on this site are without warranties of any kind. We do not warrant that the products/services offered will be exactly similar, error free, or that the defects will be corrected.


• Gift orders once placed cannot be cancelled, and any changes in the same must be notified by the sender within TWO working hours after submitting the order. Thesurpriser.com will make its best efforts to incorporate changes but will not be held responsible if an advised change is not made.


• Please note that we do not have a refund policy. However, if the customer is dissatisfied with the quality or the quantity of the products delivered, he / she should notify theSurpriser.com within 48 Hrs of the delivery of the gifts. In such an event , we may replace the items delivered subject to an approval by our Q C department. For such and exchange , the goods delivered will have to be sent to our Head Office at the recipients cost. However, we will pay for the delivery of the exchanged goods to the recipient.


• Thesurpriser.com reserves the right to dispatch the gift items separately, not as a single package, if certain items in the package are not acceptable by certain couriers.


• While thesurpriser.com takes great effort to ensure prompt possible delivery of fresh products, the responsibility for the degradation in the condition of perishable items (Flowers, Sweets, Cakes, etc.) due to late delivery in, shall be limited to replacement of the item, with fresh delivery of the same item. To avail such a redelivery, the recipient will have to contact us along with the originally delivered item, within two hours he/she receives the gift.


• Under any condition whatsoever, our maximum liability to you is limited to the dollar value of your order, which is refunded under exceptional circumstances, at the sole discretion of thesurpriser.com.


• In the unlikely event of a dispute relating to the services of thesurpriser.com,the dispute shall be subjected to the jurisdiction of Bangalore(India) courts.


• Usage of this site means that you accept the above terms and conditions in full.


• The sender is bound to above terms and conditions once he/she places the order. The sender should read the above terms and place the order with us only if they are acceptable by him/her.
